TERMS AND CONDITIONS OF USE OF THE “FOSTER.CO.UK” WEBSITE OF CANONS GROUP LIMITED, TRADING AS (“FOSTER & SON”)

Your use of the foster.co.uk website is subject to these terms and conditions of use. When you use our website you agree to be bound by and comply with these terms and conditions.

Access to and use of the foster.co.uk website implies your acceptance of and agreement with the foster.co.uk Privacy Policy as set out under “Privacy Policy“ and amended from time to time

We at Foster & Son aim to deliver impeccable service to each of our customers. If you have not been able to find the answer on our website, our sales staff are available Monday to Friday 10:00 to 18:00 GMT (5.00am – 1pm EST) on +44(0) 207 930 5385 or via email at shoemakers@foster.co.uk to assist you with questions or to help you with any problems you may experience while ordering online.

 A) SHIPMENT AND POSTAGE:

We deliver to most countries, however local import duties and additional charges may be payable on receipt. For orders placed outside the UK, please note that you are responsible for any import duties and clearance fees (where applicable) in your own country and to check the duties and clearance fees with your local authorities.

We will do our utmost to dispatch all orders promptly subject to stock availability and credit card authorisation. Many items are made up to your order and not held in stock. For those orders, our sales team will make contact to provide you with an estimated delivery date.

All deliveries are sent from London using couriers, or by mail for smaller items, and generally arrive within 3 to 5 business days of dispatch in the UK. Overseas deliveries will take a little longer and may be subject to customs delays. Deliveries to the US generally take between 7-10 business days.

We do not deliver to multiple addresses in one order, so please make a separate order for each delivery address.

Should you wish to have your shopping delivered to a different address from that on your charge card, please state this in the ‘Delivery Address’ section. Items which are sent to an address other than that of the card billing address may be subject to confirmation with the card holder.

A signature is required upon delivery and anyone at the specified delivery address can sign for the goods. Foster & Son does not take responsibility for loss or damage to goods once they have been signed for.

Please note that we deliver only Monday to Friday during working hours. Should you wish to have your shopping delivered to an alternative address please state this in the shipping address section. Items which are sent to an address other than that of the card billing address may be subject to confirmation with the card holder.

B) CUSTOMS AND TAXES:

Orders placed outside the UK, US and EU: For orders placed outside the UK, please note that you are responsible for any import duties and clearance fees (where applicable) in your own country and to check the duties and clearance fees with your local authorities.

USA: Goods are shipped to the USA net of UK VAT, however local taxes might apply depending on which state and city the shipment goes to.

UK: For goods shipped to UK, all prices are shown inclusive of UK VAT at the current rate.

EU: For goods shipped to the EU, all prices are shown exclusive of UK VAT at the current rate. However local taxes and VAT might apply in the destination country.

Rest of the World For orders shipped to countries outside the UK, prices charged will be exclusive of VAT.

C) RETURNS and EXCHANGES:

Unused footwear, luggage or accessories in original condition with an original receipt may be returned for a refund, exchange, Credit Note or Gift Voucher within 28 days of purchase. Simply contact us with your details, what item you would like to return and why and whether you would like an exchange for replacement items, gift voucher/gift card or refund.

We recommend using a registered postal service and take no responsibility for items that are lost in transit. You can usually find the process on how to return items on the back of the carrier’s dispatch note.

Please note that returning items will be at your own cost. Where we offer an exchange, if the new item costs less, we will reimburse you with the difference. If the new item costs more, an additional payment will be required. We will not charge second postage and packing costs for dispatch of exchanged goods.

If footwear has been worn outside the house, or if any purchase is scuffed, creased, stained or damaged in any other way then we reserve the right either to reject returns or to credit a lower proportion of the purchase amount.

A refund will be sent by mail within 28 days of the return date for items purchased by cheque. Please note that if you have originally paid by card and would like a refund, you will need to evidence the card used to make the original purchase.

Returns without receipt or after 28 days: Unused footwear, luggage or accessories in original condition may be returned for a Credit Note or Gift Voucher only.

All Returns must be authorized by a member of store management.

Foster & Son accept no responsibility or liability in respect of the privacy policies or data protection practices or of any contractual obligation undertaken by you with any third party reached via the Foster & Son website. E) INTELLECTUAL PROPERTY RIGHTS:

All of the elements (trademarks, logos, devices, wording, graphics, photographs and illustrations, etc.) contained in the foster.co.uk website are the exclusive property of Canons Group Limited. It is expressly forbidden to: – Reproduce by any process whatsoever all or part of any such element; – Publish, transmit, distribute or sell any such element – Modify any such element for any of the above uses

The the domain names “wsfoster.com”, “foster.co.uk” and “wsfoster.co.uk”, are and shall remain the exclusive property of Canons Group Limited. No reproduction, distribution, transmission, modification or use of these trademarks is permitted on any grounds whatsoever without the express prior permission of a director of Canons Group Limited.

For your convenience as a user of our website you are, notwithstanding, allowed to make only one single copy of any web page published on the foster.co.uk website for your own private, personal and non-commercial use, provided that any copyright and other proprietary notices displayed on such web pages shall be preserved on any such copy.

F) LIMITATION OF LIABILITY AND WARRANTY WAIVER:

Foster & Son do not accept liability to you or to any third party for any indirect, consequential or particular loss arising from your using the foster.co.uk website or from your inability to access or use the site or any part or function thereof, whether or not the eventuality of such loss has been advised to us or our agents.

Foster & Son cannot warrant that the foster.co.uk website is free of viruses, worms, Trojan Horses or other malicious software that could damage your computer or data.

Foster & Son cannot warrant that all of the data on the foster.co.uk website is accurate and up to date. The website and its contents are posted on an “as is’ and “as available” basis only. Foster & Son explicitly excludes hereby any express or implied warranty, including any implied warranty concerning the suitability of the website or any of its content for any purpose, and /or its compliance with any legal requirement.

You should be aware that the photographic rendering of colour and texture on our website may not accurately represent the actual colour and texture of the finished article as perceived when it reaches you.
